Bombay HC rejects plea for extension of filing for GST returns

The Bombay High Court has dismissed a petition seeking an extension in the filing of GST returns for the fiscal year 2019-2020.

The last date for the filing is on 28th February. There are two forms in which GST returns can be filed – GST 9 and GST 9C. GST 9 is for everyone, GST 9C is only for those for whom the GST audit is applicable. Those taxpayers who have a turnover of above Rs.2 crore are applicable for GST audit. Section 44 of the CGST Act asks for the filing of tax returns. Typically, it is supposed to be filed before 31st December but due to the pandemic, the date was extended.

Any filings after the due date will be considered late filings and a total of Rs.200 will be fined every day for a late filing.
