There will be no bar on granting anticipatory bail to the accused who called triple talaq. Under the provision of the Act, a Muslim man who announces “triple talaq” can be termed to jail sentence of 3 years. In a bench being headed by Justice DY Chandrachud it was stated that, “under Section 438 of CrPC & Section 7(c) of the Act, there is no bar on granting anticipatory bail fro an offence/crime committed under the Act”.
