Bombay High Court takes Suo Moto cognizance of Malad building collapse

On the night of Wednesday 9th July, a double-storey residential building at Mumbai’s Malad collapsed on another building taking away lives of eight children and injuring seven individuals. Regarding this issue on Friday, “The Bombay High Court takes Suo Moto cognizance of Malad Building collapse,” as reported by ANI. The matter will be heard in the court around 2:00 pm today.

Earlier the Bharatiya Janata Party spokesperson, Ram Kadam termed the death incident as ‘murder’ due to negligence through a tweet. However, the Maharashtra Minister Aslam Shaikh claimed that the building collapsed due to heavy rains.

As per earlier reports, Dilip Sawant, additional CP expressed that a proper investigation shall be carried out and further action will be taken by the police. Former Maharashtra Chief Minister Devendra Fadnavis too called for immediate assistance to families and an in-depth inquiry along with action taken against all responsible.

According to ANI’s earlier report, Vishwas Nagre Patil, Joint Commissioner of Mumbai Police informed that a case will be filed against the owner of the residential building that collapsed in Malad. He further added that the Mumbai police will register a case against the owner and the contractor of the structure that collapsed in Malad under section 304 (2) of Indian Penal Code (culpable homicide not amounting to murder).

As per Hindustan Times report, taking cognizance of the Mayor of Mumbai blaming the Bombay High Court for the recent building collapse in the city, the full bench of the HC has informed that its order to keep all orders against demolition and eviction of structures was not with regards to dilapidated buildings like the one which collapsed and led to the loss of lives.

The Bench informed that the civic corporation where at liberty to move the HC whenever there were such structures that needed urgent demolition and not to cover up its own shortcomings by blaming the HC.
