RG Kar case verdict: Kolkata court to announce punishment of Sanjay Roy tomorrow

On Monday, a Kolkata court will decide how much Sanjay Roy, who was found guilty of raping and killing a doctor who was on duty at the state-run R G Kar Medical College and Hospital here, will be punished. The counts Roy was found guilty of carry a minimum penalty of life in prison and a potential penalty of the death penalty.

Roy was found guilty on Saturday by Additional District and Sessions Judge Anirban Das of the Sealdah court of raping and killing the postgraduate trainee at the hospital on August 9 of last year. Nationwide indignation and protracted demonstrations had resulted from the horrific incident.

On August 10, 2024, Roy, a former civic volunteer with the Kolkata Police, was taken into custody one day after the body of the 31-year-old medic was discovered in the hospital’s conference room. In accordance with Sections 64, 66, and 103(1) of the Bharatiya Nyaya Sanhita (BNS), the judge found Roy guilty on Saturday of sexually abusing the doctor and strangling her to death.

According to Section 64 of the BNS, rape carries a minimum sentence of 10 years and a maximum sentence of life in prison. According to Section 66 (penalty for causing death or causing a victim to remain in a persistent vegetative condition), a person may be sentenced to at least 20 years in prison, with the possibility of being imprisoned for the rest of their natural life or until they pass away.

A person found guilty of murder under Section 103(1) of the BNS faces the death penalty or life in prison. The court stated that the more than 160-page ruling, which will be finished on Monday following the issuance of the sentence, will also definitively address some of the concerns expressed by the victim’s father, the complainant.

Das said that he had questioned some actions taken by the hospital and police authorities in the ruling. The Calcutta High Court ordered the Central Bureau of Investigation (CBI) to take over the case’s investigation from the Kolkata Police. According to the judge, the sentence will be issued once Roy’s statement is heard on Monday at 12:30 p.m.

Roy asserted in court that he had been set up when the verdict was delivered on Saturday. The deceased doctor’s parents have thanked the court for bringing about justice.
